Terms and Conditions
In using, visiting and interacting with the Adapt Motorsport website, in all of its aspects, you are deemed to have read and agreed to the following, unconditional terms and conditions provided by Adapt Motorsport here. Please read them with care.
Definitions
The following terminology applies to the terms and conditions and any other information and disclaimers provided on the Adapt Motorsport website. The terms "client", "you" and "your" refers to you, the person accessing the website and in doing so accepting the terms and conditions. "The company", "ourselves", "our", "we" and "us" refers to Adapt Motorsport. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore referring to the same definition.
The laws of Switzerland shall apply to all transactions.
Validity
These General Terms and Conditions ("GTC") apply, unless otherwise agreed in writing, to all sales and deliveries (including related activities) of Adapt Motorsport GmbH, 8706, Switzerland. The company is not bound by the buyer's terms and conditions of business or delivery or by any other documents of the buyer that modify or replace these GTC.
Changes to the GTC will be updated electronically and enter into force without any right of objection by the customer.
Payment
By placing an order and interacting with the our website you are doing so in accordance with these conditions. Adapt Motorsport is hosted by Shopify and accepts payments via credit card or Bank Transfer. Simply fill in the required details and process the payment. Once you have placed an order you are responsible for the payment of this order.
The purchase price is due in advance without any deductions according to the companies order confirmation. For order in components, items will only be ordered from the supplier after receipt of payment.
Importation Fees
You agree to bear the costs of all importation fees, duties, customs clearance fees and brokerage fees. Goods are sold CPT incoterms 2020.
Value Added Tax (VAT)
We are only registered for MWST in Switzerland and collect MWST for all deliveries inside Switzerland. The advertised price includes MWST.
We are not registered for VAT in any other country, and as such we do not charge VAT in our prices, nor collect VAT on each sale. All advertised prices outside of Switzerland are excluding VAT/GST/MWST
Risk
The risk shall pass to the buyer as soon as the goods leave the company premises. Goods are delivered under this contract in Switzerland, the buyer then becomes the importer of the goods for all international shipments.
Products
By placing an order on this website you are doing so in accordance with the following conditions.
- All prices are listed in Swiss Francs. Adapt Motorsport reserves the right to change prices at any time.
- Our products are designed and assembled in Switzerland. Due to manufacturing processes, the specifications may alter slightly from those pictured.
- Although all care and time is taken in manufacture, there may be a slight variation in the finished colour, compared to how it is displayed on the website. This is due to a range of factors from variation in computer hardware, graphics and display settings when viewing the website, down to slight batch variation in manufacturing.
- Anodised parts do vary slightly in colour for each batch. It is impossible for us to achieve perfectly match anodized parts colours from different batches. Please keep this in mind if you wish to purchase parts at different times.
When accessing, navigating and interacting with the Adapt Motorsport website, we take no responsibility in any way for the content, access or usage of any externally linked websites. Adapt Motorsport also excludes any liability arising out of or in connection with your use of this website.
Products are sold for racing and offroad use only. If the buyer installs and uses these parts for vehicles used on public roads, the buyer must ensure all modifications and conversions are recorded in the vehicle documents, and inspected and approved by the relevant local authorities. No type approvals are offered for the parts.
Products must be installed, tested and inspected by suitably experienced and qualified individuals. Parts should be inspected regularly for correct installation, wear, fatigue and damage.
Warranty
We pride ourselves in our product quality and customer service. Our standard warranty is 12 months from the date of delivery (CPT Incoterms 2020) for defects in materials used to manufacture the products, defects of workmanship under normal use.
Our warranty is only valid for the parts Adapt Motorsport parts, and if any parts, property, vehicle or other are damaged due to malfunctioning or defective Adapt Motorsport parts, Adapt Motorsport or any of its dealers/affiliates are not liable for any damages arising in contact with the malfunctioning/defective parts or because of defective parts supplied by Adapt motorsport. We are not liable for the costs of removing and installing the parts to be repaired or to be replaced, nor for any direct or consequential damages of any kind resulting from the use of defective parts.
Should a defect be discovered, please notify us so we can plan the best method of rectifying the goods, either by repair or replacement. We will determine the best course of resolution depending on the nature of the warranty claim. We may send replacement parts for the repair, or you may return the parts to us for repair, generally we do not accept refunds if a repair or replacement of the parts is possible, refunds if given are subject to a restocking fee. Please do not return goods to us without notice.
The repaired goods fall under the original coverage period and does not extend from the delivery date on the repaired or replaced part.
Modifications to our goods, using them for off road, arduous use or racing, failures resulting from negligence, improper installation, modification, tuning or incompatible parts or systems, or storage, theft or loss, or natural disaster will not be covered by the warranty. We reserve the right to make warranty provisions in these scenarios on a case by case basis.
Warranties are non transferrable.
We continuously improve our products to improve designs and performance and reserve the right to update designs or issue recalls on parts as part of our continuous improvement program. Updated parts do not infer or imply the original parts have a defect.
Parts sold at discount that are parts communicated as development, prototype or test parts come with no warranty and complete exclusion of all liabilities. Upgrades of these parts will be managed on a case by case basis as part of normal product and prototype development.
Limits of Liability
The Company’s liability under this warranty is limited to the repair or replacement of defective parts and components. Liability for damage to property or other parts or vehicles is expressly excluded.
Neither party shall be liable for any, or indirect or consequential losses arising from any breach of contract - this applies to any product or service, sold, used, manufactured, leased or delivered. In no event shall the company be liable for any indirect, special, incidental, consequential or punitive damages, including, but not limited to loss of profits, data, or use, even if the we have been advised of the possibility of such damages. This limitation of liability shall apply to the fullest extent permitted by law. The company limits its liability in respect of the product or services to: (a) the replacement of the product sold (b) the repair of the product sold.
This limit of liability extends to all employees, vendors, agents and representatives of the company.
Intellectual Property
All products on this website are protected by Copyright Laws.
Use of this site and its contents grants no rights to you in relation to any copyright, designs, trademarks and other intellectual property relating to the products on this site. Any reproductions of these items are prohibited.
You are permitted to share our images on social media if prominently linked with credit given to Adapt Motorsport.
Identification Policy
Due to the increased occurrence of credit card chargebacks and potential for fraud, we have been advised by our bank to take the following actions to protect our business against credit card charge backs. For any order deemed necessary due to value or potential risk, we will require a copy of the credit card used in the transaction (front and back), as well as a copy of photo identification with address (front and back). We recommend just using your phone camera to create the images required for sending.
Please note, the shipping address and the address on the license must match. We can not ship to a different address. For business cards, we can only ship to the business address. Please block the middle 8 digits of the credit card image for security, we only need to see the first 4 and last 3 digits on the card used.
This process is only required once as long as the same card and shipping details are used for future orders. If your details change we may request this information again.
If you do not feel comfortable suppling this information, then we will be more than happy to refund your credit card and change your payment method to Direct Deposit, Transferwise or Paypal (please note that the shipping address and paypal verified address must match).
Applicable law
The legal relationship between the company and the buyer is subject to Swiss law, even if the order was carried out abroad.
Place of Jurisdiction, Place of Performance
The exclusive place of jurisdiction for all disputes arising from the delivery and service relationship between the Company and the Buyer is the Canton of Zurich, Switzerland. The place of performance for the execution of deliveries and services is the registered office of Adapt Motorsport, 8706 Meilen, Switzerland.
Notifications
Names such as Porsche, Boxster, Cayenne, Cayman, Macan, Panamera, Carrera, 911, 924, 944, 968, 964, 993, 996, 997, 991, 992 are registered trademarks of Dr. Ing. h. c. F. Porsche AG. The use of the term Porsche serves only to describe the parts and does not establish a direct connection to the company Porsche AG. The company Adapt Motorsport GmbH has no connection with Porsche AG and acts in its own name and for its own account.
The original numbers given in some cases are for comparison purposes only. The names and addresses of our suppliers do not have to be given. The parts indicated are not purchased directly from Porsche AG.
Company logos, company names, logos or trademarks are the property of the respective manufacturers and brand owners. They serve only to describe the product. All images are for illustrative purposes only and do not show any direct relationship between our company and the products shown. This site is not associated with any of the vehicle or spare parts manufacturers mentioned.
